What are the penalties if you get caught in possession of hi cap mags in Jersey? Does anyone know the current law? Has anyone been arrested for having hi caps? Have any of the clubs been threatened or harassed?

I'm thinking of only shooting Lim-10 or single stack in NJ. I'm much too cute to go to jail! :blink:

In NJ it is a 4th degree felony to possess a magazine with a capapcity greater than 15 rounds punishable by up to 18 months in jail and a max fine of $7,500. Until very recently it was OK to block a higher cap mag with a removable block but the state AG unilaterally made that illegal.

If it were me I would stick to shooting L10, production (with mags less than 15 rounds) or revolver while in NJ. I know plenty of people shoot open and limited but they are taking a risk. I guess they have decided that the chances of getting caught are so low that it is worth the risk, but I do know of several cases where people have been arrested and prosecuted for having mags with a capacity greater than 15 rounds. It isn't common place by any means but it does happen and will happen again especially with that a-hole Corzine running the show.

I'm no lawyer, so keep that in mind. I also dont advise anyone to break the law, assuming anyone can figure out what it means.

That being said, hi-cap (more then 15 in NJ) possession is a misdemeanor, and as such unlikely to end you up in jail, unless your lawyer hates you. Also, in NJ not only is it illegal for a police officer to search your car without probable cause, it is illegal for him to search your car without cause EVEN IF YOU GIVE YOUR CONSENT. They are not allowed to even ask you for your permission to search your car. This came from the NJ Superme Court because a number of officers were doing the following: Can I search your car? No. No? then you must have something to hide, thats probable cause!

If it carries jail time of more than 12 months it is a felony not a misdemeanor.

Again, I'm don't recommend anyone depend on my nonexistent legal knowledge, nor do I recommend anyone break the law in any way.

Now lets leave the realm of sane and address NJ law ...

That being said, NJ has a screwed up crime system where we don't really have a felony definition. We have crimes of first, second, third, and fourth degrees. The first 3 are considered high misdemeanors, fourth degree crimes are misdemeanors. For the purposes of common understanding, NJ defines felony as including all high misdemeanors, but not misdemeanors. This however can lead to strange situations where the federal statues define felony as a crime which results in more then one year incarceration. Third Circuit court however decided that in cases where a overlap happens, the state's interpretation takes precedence, which would make NJ fourth degree crimes not a federal felony (Francis v. Reno). To make things more stupid, The Fourth Circuit Court held that NJ fourth degree is a federal felony, without actually addressing that it is defined as misdemeanors. New Jersey is in the Third Court area.

This should explain to everyone why I only shoot Production and L10 :)

Hey QuicksDraw, I think I can help you sleep better at night. ASAP get those mags out of Nuevo Jersey and into the Lone Star State. They are quite legal here. PM me for my mailing address. I'll give them a good home. :P

And if they are not for a Para, its justification for me to buy another gun.

NJ law is one of the major contributing factors to my being a production specialist ---- for the most part. Production's fun, but we field a whole bunch of folks in L10 every month too ---- surely you can find a pond to play in. Just remember your keys before you lock the car, and it'll all be good.....

I just might break out my trusty dusty 45 for the Jersey matches. Both Old Bridge and Central Jersey put on great matches that I would hate to give up.

Call me crazy but Corzine scares me. I have a feeling that sooner or later a Jersey match will get visited by the cops. :unsure: That guy loves headlines and we would be easy pickins. I also dont want to loose my class 3 license. No matter how stupid the law it is a law. :angry:
